Let’s Define Commercial Vehicles

However, the legal codes that apply to commercial vehicles are different than those that apply to non-commercial vehicles, so it’s important to have a clearer answer to what designates a commercial vehicle.

Even if a vehicle isn’t technically owned by a company, it may still be considered as commercial in a court of law. Take a look at these qualifying characteristics provided by the Federal Motor Carrier Safety Regulations:

  1. If a vehicle’s curb weight exceeds 26,001 pounds, it may be considered a commercial vehicle.
  2. A vehicle that is under 26,001 pounds can still be considered commercial if it is used to transport hazardous materials.
  3. If a vehicle is built to seat 16 passengers or more (including the driver), it more than likely will be considered commercial.

There are instances where these definitions would cause a truck or van to be designated as a commercial vehicle, even if it’s owned or leased by an individual and not a business.
